This website is operated by Lani Marketing. Throughout this website and these Terms and Conditions, the terms "we," "us," and "our" refer to Lani Marketing. The terms "you," "your," "user," "client," or "customer" refer to any person or business accessing this website, submitting information, requesting services, purchasing services, or otherwise engaging with Lani Marketing.
Lani Marketing offers funnel strategy, page design, funnel building, and full stack funnel system building services. Lani Marketing may also offer a free product page redesign as a promotional service intended to demonstrate strategy, layout, and conversion structure. This free service does not create any obligation for future services.
By using this website or engaging with our services, you agree to these Terms and Conditions, including any additional policies referenced or linked through this website, including any applicable Privacy Policy, Payment Policy, Refund Policy, or other related policy.
We reserve the right to update, modify, or replace any part of these Terms and Conditions at any time by posting updates to this website. Your continued use of the website or services after updates are posted constitutes acceptance of those changes.
SECTION 1. ACCEPTANCE OF TERMS

SECTION 2. SERVICES PROVIDED
Lani Marketing provides marketing and funnel related services, which may include funnel strategy, page design, and funnel building exclusively within ClickFunnels, along with funnel system structure, conversion strategy, messaging review, implementation support, and related services as defined in a written quote, invoice, proposal, or agreement.
Lani Marketing may also provide free or paid promotional offers, which may include but are not limited to product page redesigns, audits, strategy sessions, or other marketing related services. Free promotions are intended to demonstrate strategy, layout, page structure, user experience, and conversion opportunities.
Any free promotional service does not create an obligation for Lani Marketing to provide ongoing work and does not create an obligation for you to purchase additional services.
Any paid services, deliverables, timelines, and scope of work will be defined separately in writing.
SECTION 3. RESULTS AND PERFORMANCE
Lani Marketing provides strategy, design, funnel builds, system recommendations, and related services intended to support clearer messaging, stronger user experience, and improved conversion opportunities.
You understand and agree that each business, offer, audience, traffic source, market condition, product, service, and implementation environment is different. Results will vary. Lani Marketing does not guarantee any specific result, including conversions, revenue, sales, traffic, profitability, system performance, platform performance, ad performance, or business outcome.
You acknowledge that marketing performance depends on many factors outside of Lani Marketing's control, including but not limited to offer strength, pricing, audience quality, traffic source, advertising performance, brand trust, product demand, market timing, platform limitations, customer behavior, and your own implementation.
SECTION 4. COMMUNICATIONS CONSENT
By submitting your email through our website, opt in form, booking form, request form, order form, contact form, or any Lani Marketing form, you agree to receive transactional communications such as booking confirmations, booking reminders, scheduling updates, project updates, follow up questions, replies to inquiries, service related notices, support communications, account or service notices, and promotional messages, including newsletters, announcements, offers, and other messages related to Lani Marketing services, resources, events, and offers.
By submitting your phone number through our website, opt in form, booking form, request form, order form, contact form, or any Lani Marketing form, you agree to receive transactional and service related SMS messages from Lani Marketing where permitted by law.
Transactional and service related SMS messages may include booking confirmations, booking reminders, scheduling updates, project updates, follow up questions, replies to inquiries, service related notices, support communications, account or service notices, purchase related messages, and communications necessary to fulfill services or respond to inquiries.
If you provided consent to receive promotional SMS messages, you may also receive text messages about newsletters, promotions, announcements, new offers, new launches, event information, product or service information, and other marketing messages related to Lani Marketing services, resources, events, and offers.
SMS message frequency varies. Message and data rates may apply. You may reply STOP to opt out of SMS messages or contact us at contact@lanimarketing.com for help.
You may opt out of marketing emails at any time using the unsubscribe link or by contacting us directly.
Opting out of marketing communications does not affect our ability to send transactional or service related messages necessary to fulfill services, process purchases, manage appointments, provide support, or respond to inquiries.
Lani Marketing’s collection, use, sharing, and handling of contact information is described in the Privacy Policy.
SECTION 5. AFFILIATE DISCLOSURE AND THIRD PARTY PLATFORM USE
Lani Marketing may use third party platforms, tools, software, and services in connection with the services it provides. These third party platforms may include ClickFunnels, Meta, Facebook, Instagram, Google, YouTube, Twilio, Stripe, Zoom, email service providers, CRM systems, analytics platforms, automation tools, and other business or marketing tools.
5.1 ClickFunnels and Funnel Platform Use
Services are created, delivered, transferred, installed, and supported within ClickFunnels unless otherwise stated in writing.
5.2 Affiliate Links and Shared Funnels
Lani Marketing may participate in affiliate programs related to certain third party platforms. This means Lani Marketing may receive compensation if you subscribe to a platform through a provided link, referral link, shared funnel, or other shared asset.
A shared funnel may be used to transfer or make a funnel available to your account. If you choose to subscribe to ClickFunnels or any other third party platform through a link, referral, or shared funnel provided by Lani Marketing, you understand that Lani Marketing may receive compensation.
5.3 Third Party Platform Terms and Limitations
Lani Marketing operates independently and is not employed by or acting on behalf of ClickFunnels or any other third party platform. Any third party platform you choose to use is subject to that platform’s own terms, conditions, policies, fees, rules, limitations, and account requirements. You are responsible for reviewing and understanding those terms directly.
Lani Marketing is not responsible for the performance, policies, fees, limitations, availability, outages, account decisions, review decisions, approvals, disapprovals, carrier filtering, message blocking, deliverability issues, or actions of any third party platform. Your use of any third party platform is at your own risk.
SECTION 6. CLIENT RESPONSIBILITIES
6.1 Client Information and Project Materials
Client agrees to provide accurate, lawful, and complete information when using this website or engaging with Lani Marketing services.
Client shall provide any images, videos, logos, trademarks, brand assets, product information, testimonials, and other materials required for the project as specified in the applicable service agreement, proposal, estimate, invoice, or written scope of work.
Client is responsible for providing and submitting all required policies, including Terms and Conditions, Privacy Policy, Refund Policy, Payment Policy, and other applicable policies.
Client represents and warrants that all submissions are accurate, lawful, appropriate, and do not infringe on the rights of any third party.
Client is responsible for reviewing any third party platform terms that apply to the client’s account, funnel, page, website, tools, or services.
Client is responsible for decisions made based on recommendations, strategies, or deliverables provided by Lani Marketing.
6.2 Communication
Timely communication is required to complete the work Lani Marketing is hired to perform.
Client agrees to respond to Lani Marketing requests for information within 3 business days in order to adhere to project timelines. Failure to provide the requested information within 5 business days may cause the project to be placed on inactive status or closed.
If work is delayed and placed in inactive status or closed due to lack of communication within the given timeframes, failure to provide requested materials, access, approvals, or missed payments, Lani Marketing is not responsible for missed deadlines, changed timelines, launch delays, platform delays, or service interruptions caused by the delay.
The outstanding balance of the client project must be paid in full to reschedule or reopen the client project, update work completion timelines, and place the client project in active status. Additional fees or a new written agreement may be required before work resumes.
6.3 Third Party Costs
Client is responsible for all third party costs, including platform subscriptions, domains, email services, SMS services, payment processing fees, software fees, and advertising spend if applicable unless otherwise stated in writing.
6.4 Paid Traffic and Platform Account Responsibilities
When Client requests or receives advertising support, email setup, SMS setup, automation support, analytics support, CRM support, funnel support, or other platform related services, Client is solely responsible for compliance with all applicable third party platform policies, including advertising policies, account requirements, content guidelines, privacy requirements, messaging requirements, and consent requirements.
Client is responsible for maintaining advertising accounts, funnel accounts, email accounts, SMS accounts, payment accounts, analytics accounts, calendar accounts, CRM accounts, and other third party platform accounts in good standing.
Lani Marketing is not responsible for ad disapprovals, account restrictions, account suspensions, bans, rejected registrations, carrier filtering, message blocking, platform review decisions, or platform enforcement actions.
Advertising performance, email performance, SMS performance, platform performance, and business results are not guaranteed and depend on multiple factors outside of Lani Marketing’s control.
6.5 Client Compliance Responsibility
Client remains responsible for the accuracy, legality, and compliance of Client’s business, offer, product, service, content, audience, lists, data, claims, approvals, and customer communications.
Client is responsible for ensuring that all recipient lists, customer data, phone numbers, email addresses, messenger contacts, social media audiences, uploaded contacts, lead data, and related information were collected lawfully and with all required permissions, notices, consents, and authorizations.
Client represents and warrants that Client has obtained all required consent, permission, and authority to contact the recipients included in any campaign, automation, workflow, list, audience, upload, form, ad account, CRM, email system, SMS system, messenger system, funnel, or outreach process provided to Lani Marketing.
Any templates, examples, suggestions, or placeholder language provided by Lani Marketing are for general business and marketing support only and are not legal advice. Client remains responsible for having policies, notices, disclaimers, claims, guarantees, testimonials, pricing, promotions, consent language, and legal terms reviewed by qualified legal counsel before publishing or using them.
SECTION 7. SUBMITTED CONTENT AND CLIENT MATERIALS
By submitting any content, images, videos, logos, trademarks, copy, product information, testimonials, or other materials (collectively, “Client Materials”) to Lani Marketing, Client represents and warrants that Client has the legal right, permission, and authority to provide such materials for use in connection with the services.
Client authorizes Lani Marketing to use, reproduce, display, modify, adapt, publish, distribute, and incorporate the Client Materials as reasonably necessary to perform services, including but not limited to creating redesigns, building funnels within ClickFunnels, developing systems, preparing examples, and preparing related deliverables within ClickFunnels.
Client acknowledges that Lani Marketing relies on the Client Materials Client provides and is not responsible for verifying ownership, accuracy, legality, advertising compliance, platform compliance, industry compliance, consent compliance, privacy compliance, or third party rights associated with such materials. Client agrees that Lani Marketing shall not be liable for any claims, damages, or disputes arising from the use of Client Materials Client provides.
Client further acknowledges and agrees that once Client Materials are uploaded, published, hosted, or used within a third party platform, including ClickFunnels, such materials may be subject to that platform’s terms, conditions, licenses, and usage rights, which may grant the platform certain rights to use, store, display, reproduce, or distribute content within their systems.
Lani Marketing is not responsible for the ownership policies, licensing terms, content usage rights, or data handling practices of any third party platform. Client is responsible for reviewing and understanding the terms of any platform used in connection with Client’s funnel, page, or system.
SECTION 8. INTELLECTUAL PROPERTY RIGHTS
All designs, layouts, ClickFunnels funnel structures, frameworks, strategy concepts, system architecture, methods, processes, recommendations, drafts, builds, and related work created by Lani Marketing remain the property of Lani Marketing unless otherwise agreed in writing.
Lani Marketing grants rights to use specific deliverables only as stated in these Terms or in a separate written agreement.
8.1 Free Redesign License
For the free product page redesign, you are granted a limited, non exclusive, non transferable license to use the redesign for your business.
8.2 Paid Services License
For paid services, including funnel builds and system implementations, usage rights are granted only after full payment has been completed.
Until full payment has been received, no ownership, license, access, or usage rights are granted for paid deliverables, including previews, drafts, screenshots, designs, layouts, funnel structures, page builds, copy, strategy, or other work created by Lani Marketing.
After full payment and delivery (including installation or transfer to your account), you are granted a limited, non exclusive, non transferable license to use the delivered funnel and pages for your own business purposes, including use within your own business entities, brands, or accounts.
The delivered funnel, including its copy, design, structure, sequence, strategy, layout, page flow, and implementation, may constitute a unified body of work created by Lani Marketing. Your rights are limited to the permitted business use outlined in these Terms and do not include the right to reproduce, resell, redistribute, or commercially exploit substantially similar versions of the work.
Permitted use includes:
• Modifying, editing, and optimizing the funnel within your own account
• Duplicating the funnel within your own account for your own brands, offers, or campaigns
Restrictions:
• You may not represent the original work, framework, or strategy as created by you
• You may not sell, license, transfer, or provide the funnel, framework, or underlying strategy to any third party
• You may not reproduce, package, or distribute the funnel or its framework as a product, template, or service offering
• You may not create derivative works for resale that are substantially similar to the original structure, flow, or strategy
Any commercial reuse, resale, or distribution of Lani Marketing work requires prior written permission.
You may not reproduce, duplicate, copy, resell, transfer, modify for resale, recreate for resale, publish for resale, or commercially exploit any Lani Marketing work, methodology, strategy, or deliverable unless expressly permitted in writing.
SECTION 9. PAID SERVICES AND PAYMENT TERMS
Pricing for paid services is determined based on project scope and is provided in a written quote, invoice, proposal, or agreement. Scope is limited to what is expressly stated in writing.
Full payment is required before final deliverables are released, installed, transferred, or made available for use.
9.1 Payment Plans
Payment plans may be offered at Lani Marketing’s discretion. Payment plans are not subscriptions, memberships, retainers, or cancel anytime arrangements. A payment plan is a financing arrangement for the full project amount stated in the invoice, quote, proposal, or written agreement.
Payment plans represent a commitment to the full project amount, not individual phases or separate purchases. Payment plans may include additional fees and may be structured based on milestones, progress checkpoints, or time intervals.
9.2 Down Payments and Progress Payments
A down payment or initial payment is required before work begins. Standard payment structure may follow a 40/40/20 model: 40 percent initial payment before work begins, 40 percent progress payment during the project, and 20 percent final payment prior to delivery. Additional payments may be due at defined milestones, progress checkpoints, scheduled intervals, or before final delivery depending on project scope.
The exact payment schedule will be stated in the applicable invoice, proposal, or written agreement.
9.3 Final Payment and Delivery
Final deliverables, including ClickFunnels funnel installation, funnel transfer, account access, page builds, systems, or related assets, will not be released until full payment has been received.
If final payment is required before installation or transfer, Lani Marketing may send a payment page, invoice, or checkout link. Once final payment is completed, Lani Marketing may proceed with final installation, transfer, or delivery according to the project schedule.
SECTION 10. PLATFORM ACCESS, HOSTING, AND ACCOUNT RESPONSIBILITY
Lani Marketing provides services using ClickFunnels and may provide access to ClickFunnels accounts as part of services.
10.1 Client-Owned Accounts
If services are delivered to your ClickFunnels account:
• You are solely responsible for all third party subscriptions, fees, and account management• You are responsible for maintaining active status of your account• If your account is canceled, suspended, or unpaid, your funnel, pages, or services may be affected or become unavailable• Lani Marketing is not responsible for platform availability, outages, or account actions taken by the platform
10.2 Agency-Provided Platform Access
If Lani Marketing provides access to ClickFunnels through an agency account or managed environment:
• Access is provided as a service and does not grant ownership of the underlying platform account• Fees for platform access, if applicable, will be defined in a written quote, invoice, or agreement• Continued access is dependent on timely payment• Lani Marketing reserves the right to suspend or revoke access for non payment• Lani Marketing is not obligated to transfer platform ownership or account access to you• Platform availability remains subject to the platform’s own terms and performance
10.3 Third Party Costs
Unless expressly stated in writing, you are responsible for all third party costs, including but not limited to platform subscriptions, domains, email services, SMS services, payment processing fees, and advertising spend.
SECTION 11. ONGOING SERVICES, RETAINERS, AND LAUNCH SUPPORT
Ongoing services, including optimization, funnel management, reporting, updates, maintenance, or launch support, are separate from initial project services and require a separate written agreement, subscription, or retainer.
11.1 Scope and Billing
• Ongoing services are billed in advance on a recurring basis unless otherwise stated• Scope, deliverables, timelines, and availability will be defined in a written agreement• Ongoing services do not include work outside the agreed scope
11.2 Payment and Access
• If a recurring payment is missed, ongoing services may be paused or terminated• Lani Marketing is not obligated to continue work without active payment
11.3 Usage and Availability
• Ongoing services may be limited by time, scope, or availability as defined in the agreement• Unused time, services, or deliverables do not roll over unless expressly stated in writing
11.4 Launch Support
• Launch support may be provided for a defined period and scope• Services are limited to the terms outlined in the applicable agreement
SECTION 12. GRACE PERIOD AND REFUND TERMS
The initial payment includes a 24 hour refund window beginning at the time payment is made.
A refund may be requested within this 24 hour window only if work has not begun. If work has begun, the refund may be denied. After the 24 hour period ends, the initial payment is non refundable.
The 24 hour refund window applies only to the initial payment and does not apply to any subsequent payments, progress payments, milestone payments, or final payments.
If you request that work begin immediately, you understand that work may begin before the 24 hour period ends. If work has begun, refund eligibility may be denied.
Due to the digital and customized nature of services, no partial refunds are provided, and no chargebacks or payment disputes may be initiated without prior written communication.
SECTION 13. SCHEDULING AND PROJECT START DATES
Project start dates are determined by Lani Marketing’s availability and project schedule. Payment does not guarantee immediate project start.
Work will begin after the grace period ends, after the grace period is waived through immediate start, or according to the scheduled project start date established by Lani Marketing.
Lani Marketing reserves the right to schedule, reschedule, prioritize, or delay project start dates based on availability, workload, client readiness, communication, access, materials, and project requirements.
SECTION 14. NON PAYMENT, PROJECT PAUSE, AND PROJECT CLOSURE
If a scheduled payment is missed, work will stop immediately. No deliverables, access, files, installation, transfer, assets, or usage rights will be provided until payment is brought current or the project is otherwise resolved in writing.
All work remains the property of Lani Marketing until paid in full. You do not have the right to use, reproduce, recreate, implement, publish, distribute, or benefit from unpaid work.
Projects with no communication or payment activity for 30 consecutive days may be considered inactive and closed at the sole discretion of Lani Marketing.
Upon closure:
Work will not continue without re engagement.
Lani Marketing is not obligated to store, maintain, or provide access to project files, assets, drafts, builds, or related materials.
Any request to resume the project will be treated as a new engagement.
A reactivation fee may be required.
The reactivation fee will be the greater of 25 percent of the original quote or 1000.
Re engagement is subject to Lani Marketing’s current availability and may be declined.
SECTION 15. CONTENT RESPONSIBILITY
Client is responsible for all content, images, videos, testimonials, logos, trademarks, product information, claims, pricing, offers, and other materials provided to Lani Marketing.
Unless expressly stated in writing, Lani Marketing is not responsible for creating original client photography, video, product assets, brand assets, legal policies, legal disclosures, legal disclaimers, refund terms, payment terms, privacy notices, SMS consent language, email consent language, or other legally required materials.
Lani Marketing may provide placeholder visuals, mockup assets, draft copy, sample language, examples, templates, or suggested wording for demonstration, marketing, or implementation purposes. These materials are not legal advice and should be reviewed by qualified legal counsel when legal compliance, privacy compliance, advertising compliance, SMS compliance, email compliance, or industry compliance is involved.
Placeholder visuals may be used as final assets upon final payment and delivery.
SECTION 16. PORTFOLIO, CASE STUDY, AND MARKETING USE
Lani Marketing retains the right to display, publish, distribute, and promote work created for clients, including screenshots, page layouts, funnel designs, before and after comparisons, strategy examples, submitted content, images, videos, and performance examples, for portfolio, case study, marketing, educational, website, social media, presentation, and promotional purposes.
This right is perpetual and does not require additional consent once services have been rendered or work has been created.
Lani Marketing will not intentionally misrepresent client information. Sensitive or private data may be omitted or obscured when appropriate.
SECTION 17. PROPRIETARY METHODS AND CONFIDENTIAL PROCESS
Lani Marketing may use proprietary methods, frameworks, systems, processes, workflows, and strategic approaches to deliver services and recommendations.
These methods may change at any time without notice. Lani Marketing is not required to disclose specific processes, methodologies, workflows, tools, or strategic methods used to perform services. All such processes and methods are considered proprietary.
SECTION 18. THIRD PARTY PLATFORMS AND LINKS
This website or services may include references, links, integrations, or use of third party platforms, websites, tools, or services.
You acknowledge and agree that Lani Marketing is not responsible for the availability, content, terms, privacy practices, pricing, performance, limitations, technical issues, account decisions, review decisions, message filtering, deliverability, outages, data handling practices, or actions of any third party platform or service.
Your use of third party platforms is subject to the applicable third party’s own terms and policies.

No written or oral advice, recommendation, or information provided by Lani Marketing creates any warranty not expressly stated in these Terms.

Any claim, complaint, penalty, platform restriction, account suspension, message filtering, message blocking, ad disapproval, email deliverability issue, SMS compliance issue, privacy issue, or legal issue arising from your business, offer, product, service, audience, customer data, approvals, lists, claims, or failure to obtain proper consent.
SECTION 23. TERMINATION OR REFUSAL OF SERVICE
Lani Marketing reserves the right to refuse, suspend, pause, or terminate service at any time if you fail to comply with these Terms, fail to make required payments, fail to provide requested information or access, misuse deliverables, violate third party rights, engage in unlawful conduct, or otherwise interfere with the ability to complete services.
Termination, refusal, pause, or closure of services does not waive any payment obligations, intellectual property rights, portfolio rights, limitation of liability, indemnification, or other rights retained by Lani Marketing.
